CONDITIONS OF SALE
GENERAL:
Within these conditions the following definitions apply.
- "The Company" means Catering & Refrigeration Industries PTY LTD (CRI)
- "The Goods" means any components or equipment manufactured or sold by the Company.
CRI does not take any responsibility for any losses arising from:
- Lack of product or service availability
- Late deliveries
- Any losses arising due to the breakdown or malfunction of any equipment (i.e.; loss of food, employee time, loss of income etc).
- Any losses incurred arising from the purchase of any equipment from (CRI)
- Any damage incurred in transit when freight is organized by the purchaser.
All prices listed are GST exclusive, and do not include freight charges.
All pictures displayed may not reflect exact description and may reflect a different price. Please check with our sales team prior to ordering.
(CRI) has the right to change any information listed on the website at anytime with out notice
(CRI) has the right to withdraw or cancel any product purchase at any time.
APPROVED CREDIT:
Credit is extended solely at the discretion of the Company and may be withdrawn without notice temporarily or for an extended period at the discretion of the Company.
TERMS: (NON ACCOUNT ONLY).
All goods must be fully paid by clear funds prior to pick up or delivery. NO EXCEPTIONS.
TERMS OF PAYMENT: (ACCOUNTS ONLY)
Approved accounts will accept strictly nett 30 day settlement from the day of the invoice of purchase. Outstanding accounts in excess of 30 days settlement will interest at the companies ruling overdraft rate at the discretion of the Company.
Terms & Conditions
- This Agreement is subject to acceptance by Catering & Refrigeration Industries Pty. Ltd. A.C.N. 071 966 393 (The Vendor).
- If applicable, Tax is additional to the purchase price.
- The price given does not include any building alterations, plumbing or electrical work of any kind unless specified.
- The Vendor will attempt to deliver on the date’s specified buy the purchaser. The Vendor will not be held responsible for any loss of rent, stock or other expenses and losses due to late delivery.
- Any description, drawings, dimensions or weights are approximate only and any specifications are subject to change without notice.
- Delivery is subject to availability of the item as stated whether within or outside the control of Catering & Refrigeration Industries Pty Ltd.
- Cancellation of any part or whole of this agreement is at the discretion of Catering & Refrigeration Industries Pty Ltd.
- Where installation is involved, it is the responsibility of the Customer to ensure that the correct facilities are supplied to the point of situation of the item as required by Catering & Refrigeration Industries Pty Ltd and that all costs of same be met by the Customer.
- Installation is to be carried out during normal business trading hours and delay caused by lack of suitable access will result in the customer being charged additional costs for any expense incurred by Catering & Refrigeration Industries Pty Ltd.
- Where this Sale Agreement is subject to finance.
- It is herby agreed between the customer and Catering & Refrigeration Industries Pty Ltd that the finalization of this Sale Agreement is subject to finance being made available to the customer from any recognized lending institution.
- The customer agrees to supply to any such recognized lending institution or its representative any information requested to enable the lending institution to arrange such finance.
- TITLE
Title to the goods delivered on this invoice and/or delivery docket will pass to the purchaser only when payment in full has been received by the Company. Until the date of payment.- The Purchaser shall store the goods so that they are clearly identified as the property of the company;
- The Purchaser shall hold in its fiduciary capacity a separate account for all proceeds of the transactions between itself and third parties where the transactions have involved the use by the purchaser of the goods;
- If the goods are used in the manufacture and/or storage and/or packaging of the other goods the property in those other goods shall be transferred to the Company and they shall be stored so that they are clearly identified as the property of the Company provided that the purchaser may sell and deliver any such other goods to a third party in the ordinary course of business on the condition that the purchaser will assign to the Company his right in respect of the sale price thereof.
- The Company and/or its agents and/or its servants may at anytime until final payment and in the event of non payment enter the purchaser’s premises and repossess the goods. In the event of such entry and repossession the Company and/or its agents and/or its servants may take whatever steps they deem necessary to effect such entry and/or repossession.
- These terms and conditions and only there terms and conditions shall apply to any dealings between Catering & Refrigeration Pty Ltd and the customer. The customer’s trading terms (if any whether express or implied) shall have no force or effect on the dealings between Catering & Refrigeration Industries Pty Ltd and the customer, irrespective of when the customer’s terms and conditions might be received by or sent to Catering & Refrigeration Industries Pty Ltd.
- Not withstanding where this Agreement is made or entered into, it shall be deemed to have been made or entered into in the State of Victoria and shall be subject to the Laws of that State.
Warranty
This Warranty is for one year from the date of deliver including three months free service and refrigerant replacement if required on all cabinets and parts manufactured by Catering & Refrigeration Industries Pty Ltd against defective material and workmanship. The warranty is expressly limited to the replacement of any parts which may be deemed by Catering & Refrigeration Industries Pty Ltd to be faulty and expressly excludes loss of stock or custom due to equipment breakdown.
On units, motors, controls or any other parts fitted to our equipment but not manufactured by this Company, Catering & Refrigeration Industries Pty Ltd undertakes to transfer to the purchase in their entirety the benefits of the warranties given by our suppliers without, however, undertaking further liability.
This Warranty will not apply to any light or heat lamp or glass or abuse, misuse or tampering by any unauthorized person.
This Warranty becomes null and void;
- If any person other than Catering & Refrigeration Industries Pty Ltd authorized mechanics repair or service our products without the consent of this company or agents.
- If all motors and mechanical parts are not under adequate weatherproof cover.
- If power provided does not comply with power supply authority Regulations.
- If motors are not insured against fusion.
- If conditions of payment for purchase of equipment have not be fulfilled.
Whilst the company will make every endeavour to respond quickly to a service call this Warranty does not extend to any losses incurred due to delay in servicing equipment.
That in the case of second-hand or reconditioned goods, the Warranty shall be that which is specified at the time of purchased by Catering & Refrigeration Industries Pty Ltd on the said invoice which will indicate the period of time which the Warranty shall apply.
The Warranty is valid only to the owner listed on the invoice, and is the only warranty, guarantee or undertaking given by the Company in relation to the products listed on the invoice. All other conditions, guarantees, warranties, undertakings or terms are hereby expressly excluded.
